Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Flyover Sports LLC, a North Carolina limited liability company ("Flyover Sports," "we," "our," or "us"). They govern your access to and use of the Flyover Sports mobile application, the website at flyoversportsapp.com, and any related services (together, the "Service"). By downloading, installing, or using the Service, you agree to these Terms, our Privacy Policy, and our Community Guidelines, which are incorporated by reference. If you do not agree, do not use the Service.
Plain-English summary (the full Terms control): Flyover Sports is an independent aggregator. We do not own, create, or claim the scores, news, videos, podcasts, or social posts you see in the app — they belong to their publishers and are shown from official, publicly available sources with attribution. You own what you post in Team Threads and other community areas, but you give us permission to display it, and we can take it down if it breaks the rules or is reported. Please read Sections 5, 14, 15 and 16 carefully — they limit our liability and explain how disputes are resolved.

1. About Flyover Sports
Flyover Sports is a mobile sports content aggregation and fan community app built for fans in the Carolinas. The Service organizes publicly available sports content — including live scores, schedules, news headlines, YouTube creator videos, podcasts, and social media posts — and filters it to the teams you choose to follow. The Service also offers community features such as team discussion threads ("Team Threads"), reactions, and polls.
Flyover Sports is independent. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to any professional team, league, university, athletic conference, broadcaster, publisher, podcast, or creator whose content appears in the Service. Flyover Sports contains no gambling, sports betting, or wagering content of any kind.
2. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and 17, you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms on your behalf. You may not use the Service if you have previously been suspended or removed from it, or if you are prohibited from using it under applicable law.
3. Accounts
You can browse most of the Service without an account. Posting, voting, and certain other features require an account. When you create one, you agree to provide accurate information, keep your credentials confidential, and accept responsibility for all activity under your account. Notify us immediately at support@flyoversportsapp.com if you suspect unauthorized use. You may delete your account at any time from within the app or by emailing us (see our Support page).
4. Third-Party Content & Attribution
Most of the content in the Service is Third-Party Content: scores, statistics, schedules, news, videos, podcasts, social media posts, images, and similar material created and owned by third parties, including but not limited to ESPN, YouTube and its creators, X (formerly Twitter) and its users, podcast networks and hosts, and news publishers.
- We don't own it and don't claim to. Third-Party Content remains the property of its respective owners. Flyover Sports makes no claim of ownership, authorship, or exclusive rights to any Third-Party Content.
- We source it from official channels and attribute it. Third-Party Content is retrieved or embedded from publicly available sources and official platform APIs or feeds (for example, the YouTube Data API and the X API), displayed with the original creator's or publisher's name, and linked back to the original source where available. We do not alter the substance of Third-Party Content.
- It's subject to the source's own terms. Your access to Third-Party Content through the Service is subject to the terms and policies of the originating platform. In particular, video content is provided through YouTube API Services, and by using the Service you also agree to the YouTube Terms of Service and acknowledge the Google Privacy Policy.
- No endorsement, no guarantee. Inclusion of Third-Party Content or a link does not mean we endorse, verify, or are responsible for it. We do not guarantee the accuracy, completeness, timeliness, legality, or availability of Third-Party Content, and it may be removed or changed by its owner at any time. Live scores and statistics are provided for informational and entertainment purposes only.
- Rights holders: if you own content that appears in the Service and would like it removed or attributed differently, contact us at support@flyoversportsapp.com or use the process on our Copyright page. We act on valid requests promptly.
5. User Content
"User Content" means anything you post, upload, or submit through the Service, including posts and replies in Team Threads, comments, usernames, profile information, poll votes, and reports.
5.1 You own your User Content
You retain whatever ownership rights you have in your User Content. We do not claim ownership of it.
5.2 License you grant us
So that we can operate the Service, you grant Flyover Sports a worldwide, non-exclusive, royalty-free, sublicensable (to our service providers) license to host, store, reproduce, display, distribute, reformat, excerpt, and otherwise use your User Content in connection with operating, promoting, and improving the Service. This license ends when you delete your User Content or your account, except that (a) it may persist in backups for a limited time, (b) it continues for User Content that others have already shared or that we are required to retain by law, and (c) we may retain copies as needed for moderation, safety, and legal compliance.
5.3 Your responsibilities
You are solely responsible for your User Content. By posting it, you represent and warrant that: you own it or have all rights needed to grant the license above; it does not infringe or misappropriate anyone's copyright, trademark, privacy, publicity, or other rights; it complies with these Terms, the Community Guidelines, and applicable law; and it is not confidential. Do not post full articles, videos, images, or other copyrighted works that you do not own — link to them instead.
5.4 No obligation to publish; no confidentiality
User Content is public and visible to other users. We have no obligation to publish, store, or return any User Content, and we may limit its visibility, length, or reach at our discretion.
5.5 Feedback
If you send us ideas, suggestions, or feedback about the Service, you agree that we may use them without restriction or compensation to you.
6. Moderation, Reporting & Blocking
Flyover Sports is a moderated community. To keep it that way:
- We may remove content. We may, but are not obligated to, monitor User Content. We may remove, hide, edit for formatting, restrict, or refuse any User Content at any time, for any reason or no reason, with or without notice — including content that is reported by other users, violates these Terms or the Community Guidelines, or that we consider objectionable.
- Flagged content comes down fast. When User Content is flagged through the in-app report tool, we review it and act on objectionable content within 24 hours, which may include removing the content and ejecting the user who posted it.
- You can report and block. The app provides tools to report objectionable content and to block other users so that you no longer see their content. You can also report content by email at support@flyoversportsapp.com.
- Automated and human review. We may use automated filters (for example, to catch slurs, spam, or links) together with human review.
- Repeat violators lose access. Accounts that repeatedly violate the Community Guidelines, or that repeatedly post infringing content, will be suspended or terminated.
- Interactive computer service. Flyover Sports is a provider of an interactive computer service. User Content reflects the views of the user who posted it, not Flyover Sports, and we are not responsible for it. Nothing in this Section creates an obligation to monitor or a duty toward any person.
7. Prohibited Conduct
You agree not to do, or attempt to do, any of the following:
- Post content that is unlawful, defamatory, harassing, threatening, abusive, hateful, obscene, sexually explicit, or that promotes violence or discrimination against any person or group;
- Post content that infringes or violates any third party's copyright, trademark, privacy, publicity, or other rights, including reposting full copyrighted articles, videos, images, or broadcasts;
- Impersonate any person or entity — including athletes, coaches, teams, journalists, or Flyover Sports staff — or misrepresent your affiliation;
- Share another person's private or personal information without consent ("doxxing");
- Post spam, advertising, referral links, or solicitations, or promote gambling, betting, or wagering services;
- Use the Service if you are under 13, or target minors with inappropriate content;
- Access, scrape, crawl, or copy the Service or its content by automated means, or use the Service to build a competing product or dataset;
- Reverse engineer, decompile, or attempt to extract the source code of the app, or circumvent any security or rate-limiting measures;
- Interfere with the Service, its servers, or any third-party API it relies on, or introduce malware;
- Use the Service for any commercial purpose without our written permission; or
- Encourage or help anyone else to do any of the above.
8. Copyright Complaints
We respect intellectual property rights and comply with the Digital Millennium Copyright Act ("DMCA"). If you believe content in the Service infringes your copyright, please follow the notice-and-takedown procedure on our Copyright & DMCA Policy page, which includes our designated agent's contact information and the counter-notice process. We terminate the accounts of repeat infringers.
9. Intellectual Property & Trademarks
Ours. The Flyover Sports name, logo, app design, user interface, software, curation, and original text and graphics (excluding Third-Party Content and User Content) are owned by Flyover Sports LLC and protected by copyright, trademark, and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on a device you own or control, solely for personal, non-commercial use in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service.
Theirs. Team names, nicknames, logos, league names, university names and marks, network names, show and podcast titles, and all other third-party trademarks appearing in the Service are the property of their respective owners. They are used solely to identify and refer to the teams, organizations, and content being covered (nominative fair use) and do not imply any affiliation, sponsorship, or endorsement. Flyover Sports does not display official team or league logos unless licensed to do so.
10. No Gambling Content
Flyover Sports does not offer, facilitate, promote, advertise, or link to any gambling, sports betting, wagering, daily fantasy for money, or similar services. Users may not post such content. The Service is intended solely as a fan-first sports information and community platform.
11. Advertising & Sponsors
The Service is free and supported by advertising, including ads served through Google AdMob, and by local sponsors. Ads and sponsor placements are labeled as such. An advertisement or sponsorship does not constitute an endorsement by Flyover Sports, and we are not responsible for advertisers' products, services, or content. Your dealings with advertisers are solely between you and them. See our Privacy Policy for information about advertising and your choices.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to all or part of the Service at any time, with or without notice, if we believe you have violated these Terms or the Community Guidelines, if required by law, or if we discontinue the Service. Sections 4, 5.2, 5.5, 6, 8, 9, and 13 through 19 survive termination.
13. Disclaimer of Warranties
THE SERVICE, INCLUDING ALL THIRD-PARTY CONTENT AND USER CONTENT, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT SCORES, STATISTICS, SCHEDULES, OR ANY OTHER CONTENT WILL BE ACCURATE, COMPLETE, OR CURRENT. THE SERVICE DEPENDS ON THIRD-PARTY DATA SOURCES AND APIS THAT WE DO NOT CONTROL AND THAT MAY CHANGE OR BECOME UNAVAILABLE WITHOUT NOTICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYOVER SPORTS LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATING TO THE SERVICE, ANY THIRD-PARTY CONTENT, OR ANY USER CONTENT, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND DO NOT LIMIT LIABILITY THAT CANNOT BE LIMITED BY LAW.
15. Indemnification
You agree to defend, indemnify, and hold harmless Flyover Sports LLC and its members, managers, employees, contractors, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your User Content, your use of the Service, your violation of these Terms or the Community Guidelines, or your violation of any law or the rights of any third party.
16. Dispute Resolution & Governing Law
Governing law. These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of North Carolina and applicable U.S. federal law, without regard to conflict-of-law rules.
Talk to us first. Before filing a claim, you agree to contact us at support@flyoversportsapp.com with a description of the dispute and give us 30 days to try to resolve it informally.
Arbitration and class-action waiver. If we cannot resolve a dispute informally, you and Flyover Sports agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court or seek injunctive relief for infringement or misuse of intellectual property. The Federal Arbitration Act governs this Section. YOU AND FLYOVER SPORTS EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. The arbitrator may award relief only to the individual party seeking it. If this class-action waiver is found unenforceable as to a particular claim, that claim must be brought in court, and the courts named below have exclusive jurisdiction over it.
Opt-out. You may opt out of this arbitration agreement by emailing support@flyoversportsapp.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
Venue. For any dispute not subject to arbitration, you and Flyover Sports consent to the exclusive jurisdiction and venue of the state and federal courts located in Mecklenburg County, North Carolina.
17. App Store & Google Play Terms
If you download the app from the Apple App Store or Google Play, the following additional terms apply.
Apple. These Terms are between you and Flyover Sports only, not Apple Inc. ("Apple"). Apple is not responsible for the app or its content. Your license to the app is limited to a non-transferable license to use it on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Flyover Sports, not Apple, is solely responsible for the app, its maintenance and support, any warranties (to the extent not disclaimed), any product claims (including product liability, legal or regulatory compliance, and consumer protection claims), and the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app; to the maximum extent permitted by law, Apple has no other warranty obligation. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google. Your download and use of the app from Google Play are also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the app.
18. Changes to the Service or Terms
We are constantly improving the Service and may add, change, or remove features, content sources, or covered teams at any time. We may also update these Terms. If we make material changes, we will notify you by posting a notice in the app, updating the "Last Updated" date above, or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, stop using the Service and delete your account.
19. General
These Terms, together with the Privacy Policy, Community Guidelines, and Copyright & DMCA Policy, are the entire agreement between you and Flyover Sports regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, agency, or employment relationship. Notices to you may be given in the app or by email to the address on your account.
